The Trump administration filed an emergency appeal at the Supreme Court on Friday seeking to reinstate a policy<\/a> blocking transgender Americans from matching the sex listed on their passports with their gender identity. <\/p>\n

\u201cThat policy is eminently lawful. The Constitution does not prohibit the government from defining sex in terms of an individual\u2019s biological classification,\u201d Solicitor General D. John Sauer wrote to the justices<\/a>. <\/p>\n

On Inauguration Day, President Trump signed an executive order cracking down on what he called \u201cgender ideology.\u201d <\/p>\n

The State Department implemented the directive days later, requiring U.S. passports to match a person\u2019s biological sex assigned at birth. The policy also removed the option for individuals to select \u201cX\u201d as the marker, rather than male or female. <\/p>\n

A group of transgender and nonbinary Americans represented by the American Civil Liberties Union (ACLU) sued over the policy, claiming it violates federal law and their Fifth Amendment equal protection rights.\u00a0<\/p>\n

U.S. District Judge Julia Kobick, an appointee of former President Biden who serves in Boston, in June effectively blocked the policy<\/a> nationwide by certifying a class that includes transgender and nonbinary Americans. <\/p>\n

Kobick later said her ruling stood on independent grounds that remain intact in the wake of the Supreme Court\u2019s decision upholding<\/a> Tennessee\u2019s ban on gender-affirming care for minors.<\/p>\n

The administration\u2019s Supreme Court appeal comes after the 1st U.S. Circuit Court of Appeals declined to lift<\/a> the judge\u2019s block earlier this month.<\/p>\n

\u201cAs the lower courts have found,\u00a0the State Department\u2019s policy is an unjustifiable and discriminatory action that restricts the\u00a0essential\u00a0rights\u00a0of\u00a0transgender, nonbinary, and intersex citizens,\u201d Jon Davidson, senior counsel for the ACLU\u2019s\u00a0LGBTQ & HIV Project, said in a statement.<\/p>\n

\u201cThis administration has taken escalating steps to\u00a0limit\u00a0transgender people\u2019s\u00a0health care,\u00a0speech,\u00a0and\u00a0other\u00a0rights under the Constitution, and we are committed to defending those rights including the freedom to travel safely and the freedom\u00a0of everyone\u00a0to be themselves\u00a0without wrongful government\u00a0discrimination.\u201d<\/p>\n

Sauer called the block an “intolerable intrusion” on Trump’s foreign affair prerogatives.<\/p>\n

“And because of the injunction\u2019s classwide scope, the government will be forced to contradict both biological reality and its own declared policy on potentially ‘tens or hundreds of thousands’ of passports,” the solicitor general wrote.<\/p>\n

This marks the Trump administration\u2019s 27th emergency application at the high court, which has regularly intervened to lift orders blocking aspects of the president\u2019s second-term agenda.<\/p>\n

In May, the court allowed Trump to enforce his ban<\/a> on transgender troops serving openly in the military in a 6-3 split apparently along ideological lines, though the justices don’t have to publicly disclose their votes in such appeals.<\/p>\n

The new application adds to ones already pending concerning Trump’s bids to fire Federal Reserve Gov. Lisa Cook and Federal Trade Commission member Rebecca Slaughter, as well as the administration\u2019s effort to forgo spending billions in congressionally appropriated foreign aid. <\/p>\n
